By accessing or using the The AI Art Shops website (the “Site”) and its related services provided by Block Ark Studios, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with these Terms, please do not use our Service. The Service is provided on an “as is” and “as available” basis without warranties of any kind. You must be at least 18 years of age or have reached the age of majority in your jurisdiction to use our Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

+ No illegal content. OpenAI moderation will pick it up. Don't bother trying.

+ Tokens are non-refundable.

Data: Your data is securely stored using google firebase. You can delete your account, and all its associated data, at any time. Data deletion is permenant.

Data Used: We maintain basic profile data to help you manage your generated images, created products, and purchases. You have an option of saving your shipping address for ease of purchase. We do not store any payment details.

AI Data Usage: We use OpenAI's GPT-Image-1 to generate images. We save and store your generated images, but we do not save or store prompts. Your images are not used for anything other than the creation of your own custom products. You can read OpenAI's Terms of Service here.

To access certain features of our services, you may be required to create an account with Block Ark Studios. You agree that the information you provide is accurate and up-to-date and that you will update such information as needed. You are responsible for all activities that occur under your account and must notify us immediately of any unauthorized use or security breach.

All content on the Site, including text, graphics, logos, images, and software, is the property of The AI Art Shop, Block Ark Studios, or its licensors and is protected by applicable intellectual property laws. Users retain any rights to the original content they upload and AI images they create. However, by submitting content, you grant The AI Art Shop and Block Ark Studios a worldwide, royalty-free, non-exclusive license to use, modify, reproduce, and publicly display the content for the purpose of operating and promoting the Service. Users are responsible for ensuring that their use of the AI-generated images, and any derived works, complies with all applicable laws and does not infringe on the rights of third parties.

When using our website, you agree not to: a. Violate any applicable laws or regulations. b. Use the Service for any unlawful, fraudulent, or malicious purpose. c. Infringe upon or misappropriate intellectual property rights or confidential information of others. d. Upload content that is offensive, harmful, or otherwise objectionable. e. Interfere with, disrupt, or damage the operation of the Service or any linked systems.

When you place an order for a custom product, you agree to provide accurate information and complete all required fields. Payment for custom products will be processed through third-party payment processors. You agree to comply with their terms of service. The AI Art Shop reserves the right to cancel, refuse, or modify any order if fraud, error, or other issues are suspected.

The AI Art Shop may contain links to third-party websites or resources. We are not responsible for the availability, accuracy, or content of these external resources, and the inclusion of any link does not imply endorsement by us. Use such resources at your own risk.

To the fullest extent permitted by law, The AI Art Shop and Block Ark Studios shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of our services. You agree to indemnify, defend, and hold harmless The AI Art Shop, Block Ark Studios, its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or any violation of these Terms.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. The updated Terms will be posted on the Site, and your continued use of our services constitutes acceptance of those changes. It is your responsibility to review these Terms periodically. The AI Art Shop and Block Ark Studios may terminate or suspend your access to our services immediately, without notice or liability, for conduct that we believe is in violation of these Terms or is harmful to other users or our services. All provisions that by their nature should survive termination shall remain in effect. These Terms shall be governed by and construed in accordance with the laws of New York, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in New York, and the parties hereby consent to personal jurisdiction and venue therein. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. These Terms, along with any additional terms or policies referenced herein, constitute the entire agreement between you and The AI Art Shop and Block Ark Studios concerning the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written.
